AFREE TV – Privacy Policy
1. DEFINITIONS
In this Policy, unless the context requires otherwise:
“Child” means any natural person under the age of 18 (eighteen) years.
“Data Breach” means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, Personal Information under the control or possession of AFREE TV.
“Data Subject” has the meaning ascribed under POPIA.
“Employee” means any employee of AFREE TV.
“Operator” means a person or entity that processes Personal Information for a Responsible Party under a contract or mandate, without being under its direct authority.
“PAIA” means the Promotion of Access to Information Act, No. 2 of 2000.
“Personal Information” means any information relating to an identifiable natural or juristic person, as defined under POPIA.
“Policy” means this Privacy Policy.
“POPIA” means the Protection of Personal Information Act, No. 4 of 2013.
“Processing” means any operation or activity concerning Personal Information, including collection, storage, updating, use, dissemination, or destruction.
“Regulator” means the Information Regulator established in terms of POPIA.
“Responsible Party” means any person or entity that determines the purpose of and means for Processing Personal Information.
“AFREE TV” means AFREE TV (Pty) Ltd, a South African OTT and broadcast content platform, with registered business address [insert AFREE TVʼs address].
“Special Personal Information” means Personal Information concerning a Data Subjectʼs religious or philosophical beliefs, race or ethnic origin, trade union membership, political opinions, health, sexual life, biometric data, or criminal behavior.
“Third Party” means any contractor, agent, consultant, service provider, or other representative of AFREE TV.
2. PURPOSE OF THIS POLICY
The purpose of this Policy is to inform Data Subjects about how AFREE TV collects, processes, stores, and protects their Personal Information in compliance with POPIA.
This Policy applies to all Personal Information collected by AFREE TV through its platforms, services, websites, and interactions with users, subscribers, employees, suppliers, and service providers.
It does not apply to the practices of independent Third Parties that AFREE TV does not own or control, such as advertisers or linked websites, which may have their own privacy policies.
3. PROCESS OF COLLECTING PERSONAL INFORMATION
AFREE TV collects Personal Information:
Directly from Data Subjects, through account registration, content viewing, subscriptions, and communication.
Indirectly, from authorized Third Parties such as analytics providers, marketing partners, and publicly available sources.
AFREE TV ensures all collection is lawful, fair, and transparent, in line with the purposes communicated to the Data Subject.
4. LAWFUL PROCESSING OF PERSONAL INFORMATION
AFREE TV will process Personal Information only when:
The Data Subject consents to such processing.
Processing is necessary to fulfil a contract or deliver a service.
Processing is required by law.
Processing protects a legitimate interest of the Data Subject.
Processing is necessary for legitimate business interests pursued by AFREE TV or a Third Party.
Data Subjects may withdraw consent at any time; however, prior lawful processing remains valid.
5. SPECIAL PERSONAL INFORMATION AND CHILDREN
AFREE TV will not process Special Personal Information unless:
The Data Subject consents;
Required by law;
For the establishment or defense of a legal right;
The information was deliberately made public; or
For legitimate research or statistical purposes under safeguards.
AFREE TV will not process Personal Information of Children without consent from a parent or legal guardian or unless permitted by law.
6. PURPOSE FOR PROCESSING PERSONAL INFORMATION
AFREE TV processes Personal Information to:
Deliver and improve streaming and OTT services;
Authenticate users and manage accounts;
Manage supplier and service provider relationships;
Process payments and billing;
Conduct audience analytics and content performance insights;
Manage employment and HR-related processes;
Prevent fraud, monitor security, and comply with regulatory obligations;
Engage in marketing and communication activities (subject to consent);
Address user inquiries, complaints, or support requests.
7. KEEPING PERSONAL INFORMATION ACCURATE
AFREE TV will take reasonable steps to ensure that Personal Information is accurate, complete, and up to date.
Data Subjects are encouraged to notify AFREE TV of any updates or corrections to their information.
8. STORAGE AND PROCESSING
Personal Information may be stored in secure electronic or hardcopy formats within South Africa or other jurisdictions where AFREE TV or its service providers operate.
AFREE TV ensures that any Third Party processing Personal Information does so under written agreements and in compliance with POPIA standards.
9. RETENTION OF PERSONAL INFORMATION
AFREE TV will not retain Personal Information longer than necessary to fulfil the purpose for which it was collected unless:
Required or permitted by law;
Necessary to fulfil contractual obligations;
The Data Subject consents to longer retention; or
Retained for historical, statistical, or research purposes with safeguards.
Once the purpose is achieved, Personal Information will be safely deleted, destroyed, or de-identified.
10. FAILURE TO PROVIDE PERSONAL INFORMATION
Failure to provide required Personal Information may result in AFREE TV being unable to:
Deliver certain services or account features; or
Process applications, contracts, or service requests.
11. SAFE-KEEPING OF PERSONAL INFORMATION
AFREE TV implements reasonable technical, physical, and organizational measures to protect Personal Information from unauthorized access, alteration, loss, or destruction.
Security measures are regularly reviewed and updated to align with best practices.
12. BREACHES OF PERSONAL INFORMATION
In the event of a Data Breach, AFREE TV will:
Notify the Information Regulator and affected Data Subjects as required by law;
Investigate and mitigate the breach; and
Take corrective steps to prevent recurrence.
13. PROVISION TO THIRD PARTIES
AFREE TV may share Personal Information with authorized Third Party service providers to facilitate operations such as data storage, analytics, marketing, auditing, and customer support.
All such Third Parties are bound by confidentiality and data protection agreements.
14. ACCESS TO PERSONAL INFORMATION
Under POPIA and PAIA, Data Subjects have the right to:
Confirm whether AFREE TV holds their Personal Information;
Request access to such information;
Request correction, deletion, or destruction of incorrect or outdated information;
Withdraw consent or object to processing.
All such requests must be made in writing and will be handled within the timelines prescribed by law.
15. TIME PERIODS
AFREE TV will respond to access or correction requests within 30 (thirty) days, with possible extension under lawful circumstances.
16. COSTS
Applicable access fees (if any) are outlined in AFREE TVʼs PAIA Manual, available on request.
17. CHANGES TO THIS POLICY
AFREE TV reserves the right to amend this Policy periodically. Updates will be posted on AFREE TVʼs official platforms, and continued use of our services constitutes acceptance of the revised Policy.
